Online contracting of the products and/or services offered by The Owner through this website will be subject to the provisions of these General Terms and Conditions of Contract.
The Owner, through its website www.totperlairemusic.com, reserves the right to modify the commercial offer presented on said website (modifications regarding products, prices, promotions, and other commercial and service conditions) at any time. We make every effort to provide the information contained on the website truthfully and without typographical errors. In the event that such an error occurs at any time, which is beyond the control of The Owner, it will be corrected immediately.
The content of the website www.totperlairemusic.com may occasionally display provisional information about certain products. In the event that the provided information does not correspond to the characteristics of the product, the customer will have the right to cancel their purchase without any cost on their part.
All prices are cash payment prices including value-added tax plus possible shipping costs. Purchases that are to be delivered within the territory of any of the member states of the European Union will be subject to VAT.
Purchases that must be delivered in the Canary Islands, Ceuta, Melilla, or territories of non-member states of the European Union will be exempt from VAT. These shipments may incur additional customs or local tax costs.
The merchandise received must be checked by the customer within 24 hours of receipt; this is the maximum period allowed to make any claims regarding damage during transport. The customer must obtain written confirmation from the transport company regarding transport and packaging damages and must report them upon receipt of the merchandise.
Delivery time information is only binding if agreed upon in writing as a specific delivery period.
Right to Withdrawal:
The customer, as a consumer, can withdraw their contractual statement within 14 days of receipt, without providing any reason, either in writing (letter, fax, email) or by returning the merchandise.

In the case of an effective withdrawal, the performances received by both parties must be returned. The return will be made free of charge for the customer. The obligations for the restitution of payments must be fulfilled within 30 days. The period begins for the customer with the sending of the declaration of withdrawal and for The Owner upon receipt of the same.
The right of withdrawal is not valid in the case of distance selling contracts for the supply of items manufactured according to customer specifications or clearly personalized. It is also not valid for items which, due to their characteristics, cannot be returned to our facilities, are perishable, or have expired. The right of withdrawal is not valid in the case of distance selling contracts for the supply of audio or video recording items as well as software programs once they have been unsealed, as well as books, sheet music, or similar items.
The customer must bear the usual costs of returns if the supplied merchandise corresponds to what was ordered. Merchandise suitable for being sent in a package will be picked up by a transport company that we assign.
The right of return can be exercised for orders of sealed data carriers such as CDs, videos, DVDs, as well as software, provided that the corresponding merchandise is returned with the original seal.
The right of return is completely excluded for those items manufactured according to customer specifications, materials sold by the meter, items called "consumables", books, methods, sheet music, or similar items, or for items that, for hygiene reasons, cannot be accepted for return.
Warranty:
A warranty period of 24 months is granted for new items according to current legal provisions.
Defects or damages attributable to negligent or improper treatment or incorrect assembly or the use of unsuitable accessories or modifications of the original parts by the customer are excluded from the warranty.
The warranty also does not cover wear and tear from use.
If the customer accepts the merchandise or the order item knowing of a defect, said defect will be excluded from the warranty.
The customer will only have warranty rights for existing transport damages if they fulfill their obligation to inspect within the first 24 hours of receipt.
The following are excluded from the warranty:
- Second-hand devices (they have only a one-year warranty)
- Consumables of any kind, associated with an item sold or purchased separately, such as batteries, speakers, amplifier valves,...,
- Computer-related items and accessories, unless otherwise indicated in the description of the corresponding item.
- Products subject to wear and tear due to use or other types of wear and tear, as well as product defects attributable to a failure to follow usage warnings, misuse, abnormal environmental conditions, improper use conditions, overload, or insufficient maintenance or conservation.
- Product defects caused by the use of accessories, supplementary parts, or spare parts that are not original parts,
- Products in which changes or additions have been made
- Minor deviations from the prescribed condition that are not significant for the value and suitability of the product.
The repair as a warranty obligation may take place via a free repair of the defective product or by replacement with a product in impeccable or substitutive condition. The replaced products or parts become the property of The Owner.
The warranty right must be exercised within the warranty period. For this, the affected product must be returned along with a copy of the invoice.
Warranty services do not imply any extension or initiation of the warranty period for the product.
Due date and payment terms:
Invoices must be paid, unless otherwise agreed in writing, immediately and without any discount. Payment is made in cash in case of cash on delivery, if the customer places the order paying in advance or with a credit card, they will receive the merchandise delivered to their address. When paying with a credit card, the actual account debit is carried out with the issuance of the invoice and the shipment of the merchandise.
Payments made in other currencies will be credited to the account according to the bank compensation. Banking fees must be borne by the customer.
Applicable legislation and competent jurisdiction:
Purchases made on www.totperlairemusic.com are subject to current legislation. In the event of any conflict or discrepancy, the corresponding jurisdiction of the buyer's domicile will apply.
Final provision:
If any of the present provisions, regardless of the reason, becomes inapplicable, this will not affect the validity of the remaining provisions.

The material sold by The Owner has a warranty period of two years, as established by European regulation on September 11, 2003, in its Law 23/2003 on Warranty in the Sale of Consumer Goods, although damages, breakages, and/or malfunctions of those items and products that have been subjected to irregular or improper use, or that have been subjected to excessive workloads due to their form of use, are excluded from this warranty. Likewise, as stated in the Law, consumables associated with any item, such as batteries, speakers, amplifier valves, etc., are excluded from the warranty...
To make any claim, it is essential to keep the purchase invoice to access the warranty. We recommend that upon receiving your order, carefully check the packaging box and note any anomalies, deformities, bumps, or breaks you see on the box on the delivery receipt from the transport agency. The claim period established by transport agencies is 24 hours from the receipt of the order. Once this period has elapsed, no claim for transport incidents can be made. This 24-hour period refers exclusively to transport claims and does not affect the legal two-year warranty period in any way.
Excluded from the return warranty are all wear items such as books, DVDs, cables, strings, and any product that cannot be resold for hygiene reasons, such as InEar systems or headphones, ...
Upon receiving your shipment, we recommend checking the box and noting any anomalies or breaks you see on the box on the delivery receipt from the agency because all our material is shipped with transport insurance that covers the first 24 hours after you receive the material at home. Call us immediately if you detect any bumps upon receiving the products.
Remember that shipments are always insured against possible losses or damage within the first 24 hours of receiving the merchandise.
Regardless, once the legally established warranty period has passed, you will always find us to solve any problem you have with your instrument.
On the other hand, if you are not satisfied with the material even though it is in perfect condition during the first 15 days, you can return it in its original packaging along with the instruction manuals and all the accessories we sent you and without any signs of use. Once received in our warehouse, we can refund your money to your bank account or card depending on how you made the payment. You must include the “Withdrawal Form” or a similar document inside the package so that we can refund you the amount as soon as possible. Unfortunately, the round-trip shipping costs will be at your expense, as the shipping companies do not reimburse them.
Returns
As a buyer, you have the right to return the material even if it is in perfect condition within 15 calendar days from the receipt of your order.
For the refund or exchange, it is essential that you follow these steps:

2. Send us, along with the material to be returned, the withdrawal form or a similar document.
3. Return the material packaged in its intact original packaging and covered by an outer packaging, with all its accessories and without any marks. If the product is damaged, a quantitative estimation will be made and deducted from its value.
4. There are some items that, as you can understand, once opened do not admit returns, such as books, sheet music, DVDs, cables, strings, etc.
5. You must send us the material through the transport agency of your choice. Always PREPAID, we do not collect any material on a COD basis. If the material suffers any damage, the responsibility will be yours in this case of return. We recommend that you take your time packing the package properly.
6. If you make a product exchange and it is not due to our error, the shipping costs both ways will be at your expense.
Incidents with the transport agency
We carefully pack all orders so that they do not suffer any damage during transport to your home, but if you notice that any box has some breakage, dent, or bump, specify it on the delivery note that the transport agency will have you sign and contact us immediately (there is a 24-hour period from the receipt of the material to make the claim).
Opened seals
At Tot per l’Aire, we have our own quality system, and for this reason, we open a percentage of the material that reaches us. For this reason, even if you see the packaging with the seals opened, we guarantee that it is a new product and we offer you our full warranty in the same way.
If you want us not to check the material before sending it, just indicate it in the comments when placing the order.

Payment methods
We offer you the following payment methods so you can choose the one that suits you best or best meets your needs:
Cash on delivery
This option is only available for shipments through CORREOS. You will receive an email from us informing you of the package dispatch, and a notification from CORREOS via SMS or email with package confirmation. You must go to the nearest CORREOS office to your address to pick up the package and pay the total cost of the invoice.
Credit card
We accept both credit and debit cards Visa - Visa Electron, Master Card - Maestro.
Bank transfer
Once you place your order, you will receive our bank details in the confirmation email. You can make a bank transfer or a direct payment at the bank counter to the account we provide. Transfers usually take 2 to 3 business days to be processed. As soon as the payment is confirmed, we ship your order.
By sending us the payment receipt via email to info@totperlaire.com, you help speed up the shipping process.
Payment in-store
If you wish, you can come directly to our store to pick up your order and pay at the time of collection.
Payment methods for the EU
Payment in all cases must be made in advance by bank transfer or credit card in euros; no cash-on-delivery shipments will be made outside the Iberian Peninsula, nor do we conduct transactions in any currency other than euros.

Customers coming from third countries (not belonging to the EU) to personally collect their items receive their invoice with the price and 21% VAT included. To deduct the VAT, the customer must go to the customs office upon leaving Spain and send us a copy of said invoice stamped by Customs. The costs derived from the VAT refund will be borne by the customer.

Shipping and delivery times
Mainland Spain, Balearic Islands, and Portugal
Shipping costs: 7 euros (CORREOS shipping) – 12 euros (transport agency shipping)
Delivery time: 3 business days from shipping (CORREOS) – 24/48 hours (transport agency)
There are occasions when it is not possible to ship the orders promptly because some suppliers delay their delivery dates, customers who get ahead of other customers taking the last available unit, stock running out, etc. In these cases, we will inform you immediately of the delivery time of your order.
In some cases, your order will be shipped in two different shipments, as the material comes from different warehouses. This does not involve any additional cost for you.
Orders containing items with different delivery times will be shipped when all products are available to make a single shipment. If you want us to send you the available products and the rest in a second shipment, there is no problem, but you would have to pay for a second shipment.
Free shipping
If your order is over 25 euros, we will send your order FREE OF CHARGE. This promotion is only valid for shipments through CORREOS and only to Spain and Portugal. For these shipments, customs duties are included (export DUA), but remember that upon receiving the package, you will have to pay the corresponding amount for IGIC and import DUA.
